Terms of Service

These Terms of Use ("Terms") govern your use of the ClipSaver mobile application ("App"). By using the App, you agree to these Terms. If you disagree with any part of the Terms, you may not use our App.

1App Usage

1.1. ClipSaver is a tool designed to help users save and organize content from social media platforms for personal use.

1.2. You must be at least 13 years old to use the App.

1.3. You agree to use the App only for lawful purposes and in a way that does not infringe upon or restrict others' use of the App.

2Third-Party Content

2.1. No Affiliation: ClipSaver is not affiliated with, endorsed by, or sponsored by any third-party social media platforms whose content users may save using our App. Specifically, we are not affiliated with TikTok, ByteDance Ltd., Meta Platforms Inc. (Facebook/Instagram), Google LLC (YouTube), Twitter Inc., Snapchat Inc., or any other social media companies or platforms.

2.2. Terms of Service: You are responsible for complying with the terms of service of any third-party platforms from which you save content.

2.3. Content Rights: ClipSaver does not claim any ownership rights in the content that you save through our App.

3Intellectual Property and Copyright

3.1. User Responsibility: You are solely responsible for ensuring that your saving and use of any content through our App does not violate any third party's intellectual property rights, including copyrights.

3.2. Fair Use: You agree to only save content for personal, non-commercial purposes, such as personal viewing or fair use as defined by applicable copyright laws.

3.3. Copyright Claims: We respect the intellectual property rights of others and will respond expeditiously to claims of copyright infringement. If you believe that material accessible via our App infringes your copyright, please see our detailed DMCA Notice and Takedown Procedure in Section 12 below.

3.4. App Content: All content and materials available in the App, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are the property of ClipSaver or its content suppliers and are protected by copyright laws.

4Prohibited Uses

You agree not to use the App to:

  • Violate any law, regulation, or third-party rights
  • Distribute or publicly display content without proper authorization
  • Engage in commercial distribution of saved content
  • Attempt to decompile, reverse engineer, or extract the source code of our App

Failure to comply may result in termination of your access to the App.

5In-App Purchases

5.1. Payment: The App may offer in-app purchases. These purchases are processed by the App Store, not directly by us.

5.2. Subscriptions: Some features of the App may require a subscription. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.3. Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

6Warranty Disclaimer

6.1. The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

6.2. We do not guarantee that the App will always be available, uninterrupted, timely, secure, or error-free.

6.3. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any content available through the App.

7Limitation of Liability

7.1. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues.

7.2. Our total liability for any claims under these Terms shall not exceed the amount you paid to us through the App in the last 12 months.

8Indemnification

You agree to indemnify and hold harmless ClipSaver, its officers, directors, employees and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

9Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

10Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Content Reporting:

To report content that may violate copyright or for any content-related concerns, please contact us at support@clipsaver.app or use our DMCA procedure outlined in Section 12.

12DMCA Notice and Takedown Procedure

If you are a copyright owner or an agent thereof and believe that any content in our app infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing:

Required Information for DMCA Notice:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Your contact information, including address, telephone number, and email
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Counter-Notice Procedure:

If you believe your content was removed in error, you may submit a counter-notification by providing our Copyright Agent with the following information:

  • Your physical or electronic signature
  • Identification of the material that has been removed and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification

If a counter-notice is received, we may send a copy to the original complaining party informing them that we may restore the removed content within 10-14 business days. Unless the copyright owner files an action seeking a court order against the content provider, the removed content may be replaced in 10-14 business days after receipt of the counter-notice.
